These Terms and Conditions ("Terms") govern your use of the Jordi platform, including the website at jordi.winixx.net, the auth portal at auth.jordi.winixx.net, and any related mobile applications (collectively, the "Platform"), operated by Winixx Inc. ("Winixx," "we," "us," or "our").
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use Jordi.
1. Eligibility
To use Jordi you must:
- Be at least 21 years of age (25 for certain vehicle categories)
- Hold a valid driver's license issued in the United States
- Pass Jordi's identity verification process through Stripe Identity
- Not be prohibited from using the Platform by applicable law
Hosts must additionally hold a valid vehicle title or written authorization from the title holder to list the vehicle.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at support@winixx.net.
One person may hold both a host and renter account under a single Winixx identity. You may not create accounts on behalf of others or share account access.
3. Platform role
Jordi is a marketplace, not a car rental company. We connect hosts and renters but we are not a party to any rental agreement between them. Hosts are independent owners who set their own prices, availability, and pickup instructions. Renters contract directly with hosts.
Winixx facilitates payments, provides dispute resolution services, and maintains platform integrity — but we are not responsible for the condition of vehicles, the conduct of hosts or renters, or events that occur during a rental.
4. Host terms
4.1 Listing requirements
- All information in your listing must be accurate, current, and complete
- Vehicles must be road-legal, in good working condition, and currently insured in your name
- You must upload a valid vehicle registration and proof of insurance at listing creation
- You must complete Stripe Connect onboarding to receive payouts
- Vehicles must pass Jordi's approval review before becoming publicly listed
4.2 Availability and responsiveness
Hosts must keep their availability calendar accurate. Accepting a booking creates a binding commitment. Cancelling a confirmed booking more than twice in any 12-month period may result in account suspension. Hosts are expected to respond to booking requests within 24 hours.
4.3 Payouts
Hosts receive 90% of the rental subtotal (daily rate × rental days). The remaining 10% is retained by Jordi as a platform fee. Late return fees collected from renters are passed in full to the host. Payouts are processed every Monday for all completed rentals from the prior week via Stripe Connect.
5. Renter terms
5.1 During the rental
- You must be the sole driver unless additional drivers are explicitly agreed upon with the host in writing
- You must not use the vehicle for rideshare, delivery, or any commercial purpose
- You must not transport illegal substances or use the vehicle in the commission of any crime
- You must not smoke or vape in the vehicle
- You must return the vehicle with the same fuel level as at pickup (or pay a refueling fee set by the host)
- You must not drive the vehicle outside the contiguous United States without prior written consent from the host
5.2 Vehicle care
You are renting a privately owned vehicle from a real person. You are responsible for returning the vehicle in the same condition as received, normal wear excepted. Damage beyond normal wear, excessive soiling, or odor requiring professional treatment may result in charges against your payment method.
6. Payments and fees
6.1 Fee structure
- Daily rental rate: Set by the host. Charged per day.
- Service fee: Charged to the renter. Covers platform operations.
- Insurance add-on: $5.00 per day, optional at checkout.
- Late return fee: Charged per 10-minute interval after the grace period (configurable by Jordi admin; default $5.00 per 10 minutes after 15-minute grace).
6.2 Payment authorization
Payment is authorized at booking and captured on the rental start date. By providing a payment method, you authorize Jordi and Stripe to charge the applicable fees including any late return fees that accrue during the rental.
6.3 Refunds
Cancellations made more than 48 hours before the pickup date receive a full refund. Cancellations within 48 hours are non-refundable. If a host cancels a confirmed booking, renters receive a full refund.
7. Insurance
Hosts are required to maintain personal auto insurance on all listed vehicles. Jordi's optional insurance add-on provides supplemental coverage for renters during the rental period. Details of coverage limits are available at /resources/insurance.
Renters who decline the insurance add-on are responsible for any damage not covered by the host's personal policy or their own auto insurance. We strongly recommend purchasing the insurance add-on or confirming your personal policy covers rental vehicles.
8. Handoff and inspections
Both pickup and drop-off require a 6-angle photo inspection completed through the Jordi app using the device's live camera. Photos may not be uploaded from your camera roll. This requirement exists to protect both hosts and renters with a timestamped, objective record of the vehicle's condition.
By completing the pickup inspection, you confirm the vehicle matches the described condition or have documented any discrepancies. By completing the drop-off inspection, you confirm the vehicle has been returned and your rental obligations are complete (subject to any outstanding late fees).
9. Late returns
Your trip end time is set at the end of day on your return date. A 15-minute grace period applies before late fees begin accruing. After the grace period, a fee is charged for every 10 minutes the vehicle is not returned to its base location. The per-interval fee is set by Jordi and visible in the Platform settings.
Drop-off is only considered complete when you are within 0.1 miles of the vehicle's pickup address and have completed the drop-off inspection. Leaving the vehicle elsewhere does not constitute a completed return.
10. Disputes
Either party may file a dispute through the Platform for issues including vehicle damage, missing items, misrepresentation, or policy violations. When a dispute is filed:
- The rental is flagged and both parties are notified
- Jordi's support team reviews available evidence including trip photos, messages, and inspection records
- Jordi's decision is final and binding on both parties
- Chargebacks initiated outside the Jordi dispute process may result in account suspension
For disputes involving amounts over $500, you may escalate to binding arbitration under the rules of the American Arbitration Association.
11. Prohibited uses
You may not use Jordi to:
- List or rent a vehicle you do not own or have authority to list
- Circumvent Jordi's payment system (e.g., arranging payment directly with a host/renter)
- Create fake reviews or manipulate the reputation system
- Harass, threaten, or discriminate against other users
- Attempt to access another user's account or Jordi's systems without authorization
- Use automated tools to scrape the Platform
Violations may result in immediate account termination and, where applicable, referral to law enforcement.
12. Limitation of liability
To the maximum extent permitted by applicable law, Winixx's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the greater of (a) the total fees paid by you to Jordi in the 12 months preceding the claim, or (b) $500.
Winixx is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or personal injury, even if advised of the possibility of such damages.
Winixx does not guarantee the availability, condition, or suitability of any vehicle listed on the Platform.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that harms other users or the Platform. You may close your account at any time by contacting support@winixx.net. Termination does not affect any obligations that arose before termination, including outstanding payments or pending disputes.
14. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the federal or state courts located in Fulton County, Georgia, except where arbitration is required under Section 10.
15. Changes to these Terms
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
